General Terms and Conditions

These general terms govern access to and use of the LPP service by professional clients. They must be read before any subscription.

Article 1 — Purpose

These general terms define the conditions of access to and use of the LPP music broadcasting service by its professional clients (hereinafter "the Client").

Any subscription to the service implies full and unreserved acceptance of these terms.

Article 2 — Service description

LPP is a music streaming subscription service for professional establishments (bars, restaurants, hotels, shops, etc.).

The service provides access to multi-genre playlists, from lounge to house, outside the SACEM repertoire, renewed every month.

Access is provided through a client area. A compliance certificate is made available to the Client.

Article 3 — Subscription and pricing

The service is reserved for professionals acting in the course of their business.

Pricing is set on a tailored basis according to the establishment's profile; there is no public price grid, and prices are communicated by quote or following a demo.

The subscription term, renewal and billing terms are specified at the time of subscription.

Article 4 — SACEM / SPRE compliance

Les œuvres diffusées via le service sont issues d'un catalogue hors répertoire SACEM. À ce titre, leur diffusion ne donne pas lieu au versement de redevances de droits d'auteur SACEM pour ces œuvres.

La rémunération équitable (SPRE) demeure due par le Client lorsqu'elle est applicable, indépendamment du service LPP.

Le Client demeure seul responsable de ses obligations déclaratives propres, notamment pour ses événements live, soirées ou concerts, qui restent à déclarer auprès des organismes compétents selon les modalités habituelles.

LPP met à disposition un certificat de conformité ; le Client reste responsable de la conformité de son usage du service.

Article 5 — Obligations of the parties

LPP undertakes to provide access to the service under reasonable availability conditions, to renew the music catalogue and to make the compliance certificate available.

The Client undertakes to use the service in accordance with its purpose, to pay the subscription price and to provide accurate information at the time of subscription.

Article 6 — Liability

The service is provided on a best-efforts basis. LPP implements reasonable diligence to ensure the availability of the service, without being able to guarantee uninterrupted access.

LPP shall not be liable for indirect damages, nor beyond the limits provided by applicable law.

Article 7 — Personal data

Personal data collected in connection with the service is processed in accordance with the Privacy Policy, accessible from the website.

Article 8 — Term, termination and withdrawal

The subscription is taken out for the term indicated at the time of subscription. It may be terminated under the conditions and notice period specified therein.

The Client acting as a professional does not benefit from the right of withdrawal provided for consumers.

Article 9 — Force majeure

LPP shall not be liable for any failure to perform its obligations resulting from a force majeure event, within the meaning of article 1218 of the French Civil Code and applicable case law.

Article 10 — Governing law and disputes

These terms are governed by French law.

In the event of a dispute, the parties shall endeavour to reach an amicable solution before any legal action.

Failing an amicable agreement, the dispute shall be brought before the competent court: [TO FILL — Camille].
